Our company provides a wide varieties of IT products ( hardware, software & security) Consumer Electronics as well as Office Supplies and Equipment.

BY USING MAMBO SUPPLY , INC Services, the Customer agrees to these Conditions. We offer a wide range of services including online sale of tangible products, deliveries and Returns and secured credit card processing. The customer will therefore be subject to the guidelines, terms and agreements applicable to that of Mambo Supply, Inc service terms.

APPLICABLE LAW

By using Mambo Supply, Inc services, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the State of Maryland, without regard to principles of conflict of laws, will govern these conditions of use and any dispute of any sort that might arise between you and Mambo Supply, Inc.

ELECTRONIC COMMUNICATIONS

When you use Mambo Supply, Inc services, or send e-mails, text messages, and other communications from your desktop or mobile device to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notice, or notices and messages on this site or through the other Mambo Supply, Inc services, such as our message center, and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfying legal requirement that such communication be in writing.

ORDER SPECIFICATIONS

The Mambo Supply, Inc shall deliver the goods to the Location set out in the order or such other Location as the parties may agree ( delivery Location ) at any time after Mambo Supply, Inc notifies the customer that the goods are ready and shall be delivered to the new Location. Any dates quoted for delivery are approximate only, and the time of delivery is not of the essence. Mambo Supply, Inc shall not be liable for any delay or incomplete delivery that is caused by a Force Majeure event or the customer’s failure to provide adequate delivery instructions. On the other hand, both the customer and Mambo Supply, Inc can agree to re-schedule the delivery in circumstances beyound our control.

QUALITY, WARRANTY AND RETURNS

1.1 The warranty period shall be the shall the period as specified by the relevant manufacturer of the Brand of the goods on delivery. Most times the warranty period can range from 30 days to 10 years. 1.2 The Mambo Supply, Inc shall not be held liable for any warranty rules set for the particular Goods. The manufacturer who set the warranty rules shall fully be held liable for all warranties specified for the particular Goods.

PRICE & PAYMENT

The price of the Goods shall be the priciest out in the Order, or if no price is quoted, the published price on Mambo Supply, Inc website shall be the purchasing price plus the United States Tax and shipping. Unless agreed in writing by the customer and Mambo Supply,Inc otherwise all prices shall be in the United States Dollars. Our Terms of payment shall be done at check out with Credit Card, Debit Card and or Financing through our financial partners.

RISK OF LOSS

All purchases of physical items from Mambo Supply, Inc are made pursuant to a shipment contract. This means that the risk of Loss and title for such items pass to you upon our delivery to the carrier.

RETURNS, REFUNDS AND TITLE

The Mambo Supply, Inc does not take title to returned items until the item arrives at our fulfillment center. At our discretion, a refund may be issued without requiring a return. In this situation, Mambo Supply, Inc does not take title to the Refunded item.

DISPUTES

Any dispute or claim relating in any way to your use of any Mambo supply, Inc services, or to any products or services sold or distributed by Mambo Supply, Inc will be resolved by binding Arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and Federal Arbitration Law apply to this agreement.

There is no judge or jury in arbitration, and court review of an arbitration award is Limited. However, an arbitration can award on an individual basis the same damages and relief as a court ( including injunctive and declaratory relief or statutory damages ), and must follow the terms of these conditions of use as a court would.

To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our Registered Agent at : Administrator , 12503 Laurel Grove Place , Germantown, Maryland. 20874- 5360 The Arbitration shall be conducted by the American Arbitration Association ( AAA ) under its commercial rules. The AAA rules are available at www.adr.org or by calling 1-800- 778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA’s rules. We will reimburse those fees for claims totaling less than $10,000 unless the arbitrator determines the claims are frivolous. Likewise Mambo Supply, Inc will not seek attorney’s fees and costs in arbitration unless the arbitrator determines the claims are frivolous. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.

We each agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated or representative Action. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property Right.

THE MAMBO SUPPLY, INC AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS ( INCLUDING SOFTWARE ) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE MAMBO SUPPLY, INC SERVICES ARE PROVIDED BY MAMBO SUPPLY, INC ON AN “ AS IS” AND “ AS AVAILABLE “ BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. THE MAMBO SUPPLY, INC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND , EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE MAMBO SUPPLY, INC SERVICES, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS ( INCLUDING SOFTWARE ) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE MAMBO SUPPLY, INC SERVICES UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE MAMBO SUPPLY, INC SERVICES IS AT YOUR SOLE RISK.

TO THE FULL EXTENT PERMISSIBLE BY LAW, MAMBO SUPPLY, INC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. MAMBO SUPPLY, INC DOES NOT WARRANT THAT ITS SERVICES, INFORMATION, CONTENT MATERIALS , PRODUCTS ( INCLUDING SOFTWARE ) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO CYOU THROUGH THE WEBSITE SERVICES, MAMBO SUPPLY, INC SERVERS OR ELECTRONIC COMMUNICATIONS SENT FROM MAMBO SUPPLY, INC ARE FREE OF VIROUS OR OTHER HAMFUL COMPONENTS. TO THE FULL EXTENT PERMISSIBLE BY LAW, MAMBO SUPPLY, INC WILL NOT BE LIABLE FOR DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY OF OUR SERVICES, OR FROM ANY INFORMATION, CONTENT,MATERIALS PRODUCTS ( INCLUDING SOFTWARE ) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH ANY MAMBO SUPPLY, INC SERVICE, INCLUDING , BUT NOT LIMITED TO DIRECT , INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.
